1. OVERVIEW
Welcome to Ulster Collectables. References to “we”, “us”, or “our” mean Ulster Collectables.
Ulster Collectables operates this website and online store (the “Services”) to sell limited-edition collectible products. Our store is hosted by Shopify, which provides the e-commerce platform that enables us to sell to you.
These Terms & Conditions (“Terms”), together with any policies referenced herein, set out the agreement between you and Ulster Collectables and explain your rights and responsibilities when using our Services.
By accessing or using the Services, or by placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
Nothing in these Terms affects your statutory rights under UK consumer law.
2. ELIGIBILITY AND ACCOUNTS
You must be at least 18 years old to place an order.
Our products are collectible items intended for adult collectors. They are not toys and are not designed or marketed for children.
You may be required to provide accurate and complete personal, billing, and delivery information. You are responsible for ensuring this information remains correct and up to date.
You are responsible for all activity under your account and must not transfer or share your account with another person.
3. PRODUCTS AND DESCRIPTIONS
We make reasonable efforts to ensure that product descriptions, photographs, and details are accurate.
However, you acknowledge that:
- Colours and finishes may vary due to screen settings and manufacturing processes
- Minor variations in colour, alignment, or finish are normal and do not constitute defects
All products are sold as described at the time of purchase. Nothing in this section limits your right to a remedy if an item is faulty or not as described under the Consumer Rights Act 2015.
4. LIMITED-EDITION COLLECTIBLES
All Ulster Collectables products are produced in limited production runs.
Once a product is sold out:
- There is no guarantee it will be reproduced
- Variations between production runs may occur
Limited availability does not affect your statutory rights but is relevant to returns for change of mind (see Section 9).
5. ORDERS AND CONTRACT FORMATION
Placing an order constitutes an offer to purchase.
A legally binding contract is formed only once:
- Payment has been successfully processed, and
- You receive an order confirmation email
We reserve the right to refuse or cancel any order before acceptance. If an order is cancelled, any payment taken will be refunded.
6. PRICING AND PAYMENT
All prices are shown in GBP unless stated otherwise.
Prices:
- May change at any time before an order is placed
- Do not include shipping, taxes, customs, or import charges unless stated
You confirm that you are authorised to use the chosen payment method and that sufficient funds are available.
7. SHIPPING AND DELIVERY
Delivery times are estimates only and are not guaranteed.
We are not responsible for delays caused by:
- Courier services
- Customs processing
- Events outside our reasonable control
Risk of loss passes to you once the order is handed to the delivery carrier.
8. PACKAGING
Packaging is designed to protect and display collectible products.
Minor creases, scuffs, or marks to packaging caused during transit do not constitute defects unless they materially affect the product itself.
9. RETURNS, CANCELLATIONS & UK CONSUMER RIGHTS
9.1 Faulty or Incorrect Items
Under the Consumer Rights Act 2015, you have the right to a refund, repair, or replacement if an item is:
- Faulty
- Not as described
- Unfit for purpose
If you receive an incorrect or defective item, please contact us promptly so we can resolve the issue.
9.2 Change-of-Mind Returns (Cooling-Off Period)
Under the Consumer Contracts Regulations 2013, consumers normally have a 14-day cooling-off period for online purchases.
However, due to the limited-edition and collectible nature of our products, the statutory cooling-off period may not apply where items are produced in restricted quantities and are not part of regular stock.
Where the cooling-off period does apply by law, you may cancel within 14 days of receiving your order. Returned items must be unused and in original condition.
This does not affect your rights in relation to faulty or misdescribed items.
9.3 Exclusions
We do not accept returns for:
- Change of mind where the cooling-off period does not apply
- Items damaged due to misuse, wear, or handling after delivery
10. RESALE
Customers may resell items they have purchased.
Ulster Collectables has no involvement in secondary market pricing or resale activity and offers no guarantees regarding future value.
11. INTELLECTUAL PROPERTY
All designs, artwork, images, branding, and content are owned by Ulster Collectables or its licensors.
Our products are independently designed and manufactured and are not affiliated with, endorsed by, or associated with any other manufacturers or organisations.
You may not copy, reproduce, or use our intellectual property without prior written permission.
12. AFFILIATIONS
Ulster Collectables is not affiliated with any political organisation or party.
13. PROHIBITED USE
You must not use the Services for unlawful purposes, including but not limited to:
- Infringing intellectual property rights
- Harassment or abusive behaviour
- Uploading malicious code
- Attempting to interfere with site security
We reserve the right to suspend or terminate access for violations.
14. DISCLAIMER OF WARRANTIES
Except where required by law, the Services and products are provided “as is” and “as available.”
Nothing in these Terms excludes or limits warranties or remedies that cannot be excluded under UK law.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Ulster Collectables will not be liable for indirect or consequential losses arising from use of the Services or products.
This does not limit liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded by law.
16. INDEMNITY
You agree to indemnify Ulster Collectables against claims arising from your breach of these Terms or misuse of the Services.
17. TERMINATION
We may suspend or terminate access to the Services at any time. Obligations incurred before termination remain enforceable.
18. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
19. ENTIRE AGREEMENT
These Terms, together with referenced policies, constitute the entire agreement between you and Ulster Collectables.
20. ASSIGNMENT
You may not assign your rights without our consent. We may assign our rights at any time.
21. GOVERNING LAW
These Terms are governed by the laws of Northern Ireland / United Kingdom, and the courts of that jurisdiction shall have exclusive authority.
22. CHANGES TO TERMS
We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
